Terms and Conditions:
Pupil’s commitment
- Payment first lesson of instruction must be made at the time of booking Driving Lesson.
- subsequent lesson payments one week prior to each lesson no later than Saturday before unless a block booking is made.
- payments to be made by bank transfer ,cash , in app payment or website payments
- Pupil will ensure they attend lesson on time no show after 15 minutes lesson will be cancelled and charged unless prior communication
- Ensure theory test is passed in a timely manner
- I agree to disclose any medical issues which may affect my ability to drive
- Multiple cancellations of lessons or none payment– if you cancel more than 2 lessons in a row or 4 lessons in total,or if you fail to pay on time you may lose your lesson time slot to another student and be put back on my waiting and lesson gaps list, this is at my sole discretion
- I agree to pay all lessons in a timely manner late payments may result in cancellation of lesson and loss of slot
- I agree to attend all lesson slots unless other wise agreed with instructor subject to cancellation policy clause 3
- The Pupil certifies that a valid suitable Driving Licence is held to drive the tuition vehicle. Pupils must inform their Instructor immediately if they receive any endorsements on their Driving Licence during the period they are receiving tuition. You must be able to pass the DVSA eyesight check before driving. Your instructor reserves the right to cancel the lesson if you fail this test.prior to lessons a check code and license number needs to be provided to check validity of license
- Pupil certified they are fit and proper to drive ,ie there eye sight meets the legal requirements they are not under the influence of drugs legal or otherwise and also not under the influence of drink
Tests
- Pupil must pass 2 mock tests to prove readiness for test
- If your driving standard isn’t test ready and safe you will not be allowed use of the driving school vehicle this may be removed at any point so just because a test is booked the vehicle can be withdrawn if the pupil fails to drive safely
- Driving Tests may only be arranged with the prior agreement of both the Instructor and the Pupil.use of the instructors car for tests is at the instructors discretion.
- Payment for sitting a practical driving test is paid directly to the DVSA, however this does not include the use of a tuition vehicle. Therefore, a payment must be made to your Driving instructor directly for use of the vehicle and time spent travelling to and from the test centre.
- The driving instructor/school accepts no responsibility for loss of earnings due to test vehicle been withdrawn
- If the DVSA cancel a test due to sickness or examiners been unavailable the test day fee will still be charged which can be claimed back from the DVSA , if cancels due to weather the test will be converted into a lesson and still charged as this cannot be claimed from DVSA
LEGAL LIABILITY.
- Your instructor will make every effort to avoid you breaking the law or committing any traffic offence – you are under their close supervision during every lesson and they may use verbal or physical control such as giving verbal instruction, taking the steering wheel or using the dual control pedals where necessary to avoid dangerous situations or accidents. However, your instructor cannot accept any responsibility of you breaking the law – this includes speeding, traffic offences, regulations, or laws that you could break whilst driving. Any fines or penalties are legally the sole responsibility of the driver. It is an offence on your instructor's part if they fail to give the driver’s details to the police when asked to provide information as to who was driving at the time of an offence. It is important that you are aware of your legal responsibilities as a driver.
- The Pupil should be aware that the Instructors primary objective is to promote road safety and in doing so, he/she may take control of the vehicle. The Instructor will make every effort to instruct the Pupil to the highest standard but can in no way be held liable for any errors that the Pupil may make whilst driving and not accompanied by the Instructor either before or after a Driving Test Pass.
- The Instructor will endeavour to teach the Pupil the correct driving skills according to the recommended syllabus issued by the DVSA within the minimum number of driving lessons required.
- The Instructor will accept no liability for accidents, injury or damage to any Third Party caused by the Pupil’s recklessness or negligence during a lesson.
- Personal data, and/or information about you, that you provide to Driving School and/or your Instructor may be used in accordance with our Privacy Policy, this is available at www.Learn2Drivecannock.co.uk
- If the Pupil agrees, the Instructor may take photographs / videos of the Pupil after their Driving Test and request a positive Customer Review.The photo/video will be used on the schools social media and website accepting having the photo taken is acceptance of been posted and used for said purpose.
Cancellation policy
1. If you need to cancel or change your lesson appointment you must give a minimum of 48 hours’ notice by phone call or SMS text message and you need to have had a reply from me confirming I have received your message regarding the lesson move request or cancellation or you will forfeit that lesson fee. No other form of notification is acceptable.
2. If you stop a lesson part way through or finish early, you will still be charged for the remainder of the lesson and will not be entitled to a refund or credit.
3. Multiple cancellations of lessons – if you cancel 2 lessons in a row or 4 lessons in total, you may lose your lesson time slot to another student and be put back on my waiting and lesson gaps list, this is at my sole discretion.
4.Verbal and physical abuse/threats will NOT be tolerated in person or through any form of communication and will result in the termination of that lesson and all subsequent lessons. This will be at my sole discretion. You will have to make your own way back to wherever it is you want to go, at your own expense. You will forfeit any and all monies already paid.
5.I reserve the right to cancel/amend driving lessons at any time if I am unable to keep the appointment due to any unforeseen circumstances such as but not limited too mechanical breakdown, sickness, pre-booked holidays, family emergency or due to immovable traffic. In the event of pre-booked driving tests, where possible I will do my best to source another training car but I give no guarantee of this.
6.if pupil fails to attend a lesson you will have received notifications 72 hours prior of your lesson and that I have arrived, after 10 minutes your lesson will be cancelled and you will be charged for the lesson.
Refunds
1. Refunds are at my sole discretion.
1a. You will not be entitled to any refund if you break any of the terms and conditions.
2. Refunds may take up to 28 days to process.
3. Refunds will only be paid into a bank account in the student’s name.
3a.It is your responsibility to provide the correct bank details to receive a refund, once the refund has been issued, errors cannot be corrected.
4. I am unable to offer a refund in the event of a cancellation, however I am happy for you to reschedule to another date which is mutually agreeable as long as the lesson cancellation followed our cancellation policy.
5. You are not entitled to a refund simply because you changed your mind.
6. You are not entitled to a refund as a result of a problem with a service that was completely outside of my control. For example ; the examiner is unavailable on the day of your test and your test is cancelled - if this is the case you may be able to claim costs back from the DVSA.
7. Refunds of part used block payments will lose the promotional rate. Any credit already used will be charged at the normal hourly rate, the remaining credit will be refunded.
Example for illustrative purposes only. You paid £340.00 for 10 hours tuition and used 6 hours of tuition. You would pay the full rate of £40.00 per hour for the 6 hours equal to £240.00. You would be entitled to a refund of £100.00 less the £30.00 administration charge, meaning you would receive back £70.00.
